Terms of service
The agreement between you and us when you use HeisenBERT. Plain language where we can, precise where we must.

The agreement
These terms are a contract between you and Chronic Qual SRL, Romania, tax ID (CUI) 29400617(“we”, “us”), for the HeisenBERT website, app, website chat and API (“the service”). By creating an account or using the service you accept them. If you use HeisenBERT for a company, you accept them for that company. Our privacy policy explains how we handle personal data.
Your account
- You must be at least 16, and old enough to make a contract where you live to buy a paid plan.
- Keep access to your email and Google account safe: whoever controls them can sign in as you.
- Give us accurate billing details. One person or company per account; don’t share it or resell access.
Plans, credits and payment
- Plans. Free, Creator and Pro, with the features and prices shown on our plans page. Prices are in euro; VAT is added where it applies.
- Credits. AI features use credits. Free includes a monthly amount that resets on the 1st of the month (UTC) and does not roll over. Creator and Pro add their credits each time the plan is paid for 30 days, on top of what you have left: unused plan credits carry over for as long as you keep renewing, and expire if the plan isn’t renewed within 48 hours of its due date. Extra credits you buy stay valid for 12 months, on any plan. Credits have no cash value and can’t be transferred.
- Charges. The app shows what each action costs before or as you use it. If something fails on our side, the credits are returned automatically.
- Billing. Paid plans run 30 days at a time and are paid in advance, through Stripe. By default you renew by hand: you can pay for the next 30 days from 7 days before your plan is due, and the new period starts on the due date. You can also turn on auto-renew, which charges your card each month until you turn it off in the billing portal (it then runs to the end of the period you paid for). Moving up to a bigger plan starts a new 30-day period on the day you pay, with its full credits added; a smaller plan takes over on your next due date.
- Grace period and Free. If a plan isn’t renewed by its due date, it keeps working for 48 hours. If it’s still not renewed after that, your account moves to Free automatically: unused plan credits expire, plan features stop, and your library becomes download-only for 30 days. After those 30 days, we delete your oldest recordings until your library fits Free’s limit. Renewing within the 30 days ends this, and nothing is deleted.
- Library space. Every plan includes a recordings library (Free 1 GB, Creator 25 GB, Pro 100 GB). On Creator and Pro you can add space in blocks of 50 GB for 100 credits each, renewed from your credits every 30 days until you cancel; cancelling keeps the space until the end of the 30 days, and adding blocks mid-period costs the days left. If a renewal can’t be paid, the space ends. If your library holds more than your plan and extra space allow (also after a plan or voucher ends), we email you, and after 30 days we delete your oldest recordings until it fits. Deleted recordings can’t be recovered.
- Uploads. You can upload MP4, MOV or WebM videos of up to 20 GB and 4 hours, that you have the rights to. Files that aren’t such videos are refused and deleted.
- Clip kit. Clips you add to your clip kit can be played and downloaded by anyone with its link, and you allow them to repost those clips under the credit and rules you set there. Add only clips you have the rights to share, including anything you show from others. Taking a clip out, or making a new link, stops new downloads, not copies already made.
- Reminders. We email you 48 hours before a plan that doesn’t renew on its own is due, again on the due date, when a payment fails, when a plan moves to Free (with the date your library would be trimmed), 3 days before recordings are deleted, and before extra space renews or a voucher plan ends, so you can act in time.
- Voucher codes. A voucher gives a plan free of charge for the time it states. Each code works for the number of accounts it was made for, first come first served, once per account and only on the Free plan; codes have no cash value and can’t be exchanged. When the free period ends, the plan follows the same 48-hour grace period as a paid plan; you can pay for it or turn on auto-renew beforehand, and billing starts only when the free period ends. We can cancel codes that haven’t been redeemed yet.
- Price changes. We’ll tell you at least 30 days before a price change applies to your plan, and you can cancel before it does.
Right of withdrawal (EU consumers)
If you are a consumer in the EU, you normally have 14 days to withdraw from a purchase. Because HeisenBERT is digital content and a service that starts right away, you agree when buying that we start immediately and that you lose the right of withdrawal once the service has been fully provided, or for a plan or credits once you start using them. If you haven’t used a new subscription or credit pack, write to us within 14 days for a full refund.
Invite and earn
- Credits, not cash. Rewards are credits on your account. They can’t be exchanged for money, sold or transferred, and last 12 months like credit packs.
- Welcome credits. When someone signs up through your link and uses Bert for the first time, you each get 50 credits. Up to 20 of these a day per inviter.
- Shares of payments. From the Rising tier, you earn a share of what the people you invited pay (after VAT and refunds), as credits, for 12 months from their sign-up. Shares arrive 30 days after each payment and are cancelled or taken back if it’s refunded.
- Free plans with a tier (Partner, Ambassador) last while you hold the tier and, for Partner, while your link is live. They end without notice when that stops, and never replace a plan you pay for.
- Fair play. Inviting yourself, using several accounts, fake or automated sign-ups, spam, or ads that bid on our name don’t count; we may cancel rewards, take credits back and close the account.
- Say it’s a paid partnership. Credits are a benefit for promoting us, so tell your audience (for example #ad, or YouTube’s “includes paid promotion”), as consumer law requires. Don’t make claims about Bert that aren’t true.
- We can change or end the program with 30 days’ notice; credits you’ve already earned stay yours.
Your content
You own what you create with HeisenBERT: your recordings, transcripts, characters, and what Bert and the helpers produce for you, to the extent the law allows it to be owned. You give us permission to store and process your content only to run the service for you. We don’t claim ownership of it and don’t use it to train AI models.
You are responsible for having the rights to what you upload, record, stream or ask Bert to create.
Acceptable use
Don’t use HeisenBERT to:
- impersonate a real person, or create characters, voices or videos that look or sound like a real person without their permission;
- mislead viewers into thinking AI-generated content is real where that could cause harm, including news, elections, health or finance;
- create sexual content involving minors, or content that is illegal, harassing, hateful or violent towards others;
- infringe copyright, trademarks or other people’s rights;
- break YouTube’s rules or the rules of any platform you stream to;
- spam, scrape, or attack the service, get around plan limits or rate limits, or resell the API without our written agreement.
If you break these rules we may remove content, pause features, or close your account, in proportion to the problem, and we’ll tell you why unless the law or safety prevents it.
AI disclaimers
- Bert can be wrong. His answers (including replies he posts in your live chat), web search results, fact checks, titles, chapters and other helper output are generated by AI. They may be inaccurate, incomplete or out of date, even when they cite sources. Check anything that matters before you publish it.
- Fact-checking is a help, not a guarantee. Bert may miss mistakes, or flag correct statements as wrong.
- Chat moderation is a help, not a guarantee. When you turn it on, Bert removes or flags messages and times viewers out on your behalf, following your settings. He can miss abuse or remove a harmless message. Your channel and its chat stay your responsibility, under each platform’s rules.
- Editing suggestions are suggestions. Transcripts and the cuts and Shorts the AI suggests can be wrong. Watch an edit before you publish it.
- Remembering your viewers is your choice. With “Remember regulars” on, we keep a short record of the people in your live chat on your behalf (see the privacy policy). Use it only to run your streams, tell your viewers if your own rules require it, and delete a viewer’s record when they ask.
- Not professional advice. Nothing Bert says is legal, medical, financial or other professional advice.
- Synthetic voices and faces. Bert and your characters are AI-generated. Where a platform or the law requires it (including YouTube’s rules on altered or synthetic content and the EU AI Act), you must tell your audience. We label Bert as AI in the app and in website chats.
- Generated characters. Images are made by AI from your description. They can accidentally resemble existing people or works; don’t publish one that does.
YouTube and Google
Streaming to YouTube uses YouTube API Services. By connecting YouTube you also agree to the YouTube Terms of Service. You can remove our access at any time in your Google account permissions. What you stream is your responsibility, and YouTube may apply its own rules to it.
Website chat and API (Pro)
- Keep your API keys secret and use them only from your servers. You pay for all use made with your keys and website chats.
- Tell visitors that your website chat is AI and is run by HeisenBERT, and cover it in your own privacy notice. For their messages, we process data on your behalf.
- We may rate-limit or pause a chat or key that is being abused, to protect you and the service.
Availability and changes
We work to keep HeisenBERT running and your recordings safe, but we can’t promise it will always be available or error free. We rely on AI and infrastructure providers that can change or fail. Keep your own copy of recordings you care about; saved recordings are deleted after 90 days. We may improve or change features; if we remove something you pay for, we’ll tell you in advance and you can cancel.
Liability
Nothing in these terms limits liability that can’t be limited by law, such as for intent, gross negligence, or your rights as a consumer. Otherwise, we are not liable for indirect losses such as lost profits, lost revenue or lost views, and our total liability for any claim is limited to what you paid us in the 12 months before it arose. Consumers keep all their statutory rights, including the legal guarantee of conformity for digital content and services.
Ending the agreement
You can stop using HeisenBERT and delete your account yourself at any time, on the Account page. We may end the agreement with 30 days’ notice, or right away for a serious breach of these terms. Unused monthly credits end with the account.
Law and disputes
Romanian law applies, and the courts of Romania have jurisdiction, without taking away the protection of the consumer laws of the country where you live, or your right to go to court there. If something goes wrong, please write to us first; most things get solved that way. Consumers in Romania can also contact ANPC (anpc.ro).
Changes to these terms
We’ll email you at least 30 days before a significant change applies. If you don’t agree, you can cancel before then.
